OLIO SASA has established the present privacy policy, the purpose of which is to transparently inform users of the website hosted at the following address: https://www.ilanga-nature.com/ ,(hereinafter the “Site”), of the manner in which personal data is collected and processed by OLIO SASA.

The term “User” refers to any individual or legal entity visiting or interacting in any way with the Site.

As such, OLIO SASA determines all the technical, legal and organizational means and purposes of processing Users’ personal data. To this end, OLIO SASA undertakes to take all necessary measures to ensure that personal data is processed in accordance with the Law of July 30, 2018, on the protection of individuals with regard to the processing of personal data (hereinafter, “the Law” ) and the European Regulation of April 26, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter, “the Regulation” ).

OLIO SASA is free to choose any individual or legal entity that processes Users’ personal data at its request and on its behalf (hereinafter the “Processor” ). Where applicable, OLIO SASA undertakes to select a Subcontractor offering sufficient guarantees as to the technical and organizational security measures for the processing of personal data, with regard to the Law and the Regulation.

1. Processing of personal data

The use of the Site by Users may entail the communication of personal data. The processing of such data by OLIO SASA, in its capacity as Data Controller, or by service providers acting in the name and on behalf of OLIO SASA, will comply with the Law and the Regulation.
Personal data will be processed by OLIO SASA, in accordance with the purposes set out below, via :
An automated procedure;
The newsletter registration form;
The use of cookies;
Sending surveys or questionnaires.

2. Purpose of personal data processing

In accordance with Article 13 of the Regulation, the purposes for which personal data is processed are communicated to the User and are as follows:
1. To ensure the performance of the services offered and agreed upon on the Site;
2. To monitor the performance of the services offered;
3. To carry out marketing activities and promotional information after prior consent from the User and until such consent is revoked, for example the sending of promotions on the Data Controller’s products;
4. To answer the User’s questions;
5. To compile statistics in order to improve the Website, the services offered and the internal organization of operations;
6. To improve the quality of the Site and the products and/or services offered by the Data Controller;
7. To better identify the User’s interests.

3. Generality

When visiting and using the Site, the User consents to the collection and processing of the following personal data in accordance with the terms and principles described in this Privacy Policy:
1. Information provided by the User for contractual purposes and to enable the proper performance of reciprocal obligations, i.e. surname, first name, address, etc.; and more generally, any information voluntarily provided by the User;

4. Consent

By accessing and using the Site, the User declares that he/she is aware of and gives his/her free, specific, informed and unequivocal consent to the processing of his/her personal data. This agreement relates to the content of the present Privacy Policy.

5. Retention period of Users' personal data

In accordance with article 13 paragraph 2 of the Regulation and of the Law, the Data Controller only keeps personal data for as long as is reasonably necessary to achieve the purposes for which they are processed.

This period will in all cases be less than 3 years.

6. Recipients of data and disclosure to third parties

Personal data may be transmitted to employees, collaborators and subcontractors who offer adequate data security guarantees and who collaborate with OLIO SASA in the provision of services. They act under the direct authority of OLIO SASA, and are in particular responsible for collecting, processing or subcontracting such data.

In all cases, the recipients of data and those to whom such data has been disclosed shall comply with the contents of this Privacy Policy. OLIO SASA assures that they will process such data solely for the purposes intended, in a discreet and secure manner.

In the event that data is disclosed to third parties for direct marketing or prospecting purposes, the User will be informed in advance so that he/she may express his/her consent to the use of such personal data.

8. User rights

1.Right of access

In accordance with article 15 of the Regulations, OLIO SASA guarantees the User’s right of access to their personal data. The User has the right to obtain access to said personal data as well as the following information:

  • the purposes of the processing;
  • the categories of personal data concerned;
  • the recipients or categories of recipients to whom the personal data have been or will be communicated, in particular recipients who are established in third countries or international organizations;
  • where possible, the planned retention period of the personal data or, where this is not possible, the criteria used to determine this period;
  • the existence of automated decision-making, including profiling, referred to in Article 22, paragraphs 1 and 4 of the Regulation, and, at least in such cases, useful information regarding the underlying logic, as well as the significance and anticipated consequences of this processing for the data subject

The Data Controller may require payment of a reasonable fee based on administrative costs for any additional copies requested by the User.

When the User submits this request electronically (via the email address for example), the information is provided in commonly used electronic form, unless the User requests otherwise. .

A copy of their data will be communicated to the User no later than one month after receipt of the request..

2. Right of rectification

OLIO SASA guarantees the user the right to rectify and erase personal data.

In accordance with Article 16 of the Regulation, incorrect, inaccurate or irrelevant data may be corrected or deleted at any time. The User first makes the necessary modifications himself from his user/other account, unless these cannot be carried out independently, in which case the request can be made to OLIO SASA.

In accordance with Article 19 of the Regulation, the Data Controller notifies each recipient to whom the personal data has been communicated of any rectification of the personal data, unless such communication proves impossible or requires disproportionate effort. The data controller shall provide the data subject with information about these recipients upon request.

3. Droit à l’effacement

The User has the right to obtain the erasure of his personal data as soon as possible in the cases listed in article 17 of the Regulations.

Where the Data Controller has made personal data public and is required to erase them pursuant to the previous paragraph, the Data Controller, taking into account available technologies and implementation costs, takes reasonable measures , including of a technical nature, to inform other controllers processing such personal data that the data subject has requested erasure by such controllers of any links to, or copies of, such personal data or reproduction thereof.

The previous two paragraphs do not apply to the extent that this processing is necessary:

to the exercise of the right to freedom of expression and information;
to comply with a legal obligation which requires processing provided for by Union law or by the law of the Member State to which the controller is subject, or to carry out a task of public interest or relating to the exercise of the public authority vested in the controller;
for the establishment, exercise or defense of legal rights.

In accordance with Article 19 of the Regulation, the Data Controller notifies each recipient to whom the personal data have been communicated of any erasure of personal data or any limitation of the processing carried out, unless such communication proves impossible or requires disproportionate effort. The data controller shall provide the data subject with information about these recipients upon request.

4. Right to restriction of processing

The User has the right to obtain limitation of the processing of his personal data in the cases listed in Article 19 of the Regulations.

In accordance with Article 19 of the Regulation, the Data Controller notifies each recipient to whom the personal data have been communicated of any limitation of the processing carried out, unless such communication proves impossible or requires disproportionate effort. The data controller shall provide the data subject with information about these recipients upon request.

5. Right of data portability

In accordance with article 20 of the Regulations, Users have the right to receive from OLIO SASA personal data concerning them in a structured, commonly used and machine-readable format. Users have the right to transmit this data to another data controller without OLIO SASA obstructing this in the cases provided for by the Regulations.

When the User exercises his or her right to data portability pursuant to the preceding paragraph, he or she has the right to obtain that personal data be transmitted directly from one data controller to another, when technically possible.

The exercise of the right to data portability is without prejudice to the right to erasure. This right does not apply to processing necessary for the execution of a mission of public interest or relating to the exercise of public authority vested in the controller.

The right to data portability does not infringe the rights and freedoms of third parties.

6. Right to object and automated individual decision-making

The User has the right at any time to object to the processing of his personal data due to his particular situation, including the automation of data carried out by OLIO SASA In accordance with article 21 of the Regulations, OLIO SASA will not process plus personal data, unless there are legitimate and compelling grounds for the processing which override the interests and rights and freedoms of the User, or for the establishment, exercise or defense of rights in justice.

When personal data is processed for prospecting purposes, the User has the right to object at any time to the processing of personal data concerning him or her for such prospecting purposes, including profiling to the extent where it is linked to such prospecting.

If the data subject objects to the processing for direct marketing purposes, the personal data will no longer be processed for these purposes.

11. Security

The Data Controller implements organizational and technical measures to guarantee a level of security appropriate to the processing and collection of data. These security measures depend on the costs of implementation with regard to the nature, context and purposes of the processing of personal data.

The Data Controller uses standard encryption technologies within the IT sector when transferring or collecting data on the Site.

12. Modification of the Privacy Policy​

OLIO SASA reserves the right to modify this Privacy Policy in order to comply with legal obligations in this matter. The user is therefore invited to regularly consult the Privacy Policy in order to be aware of the modifications and adaptations. Such a modification will be displayed on the Site or sent by email for opposability purposes.

13. Applicable law and competent jurisdiction

This Privacy Policy is exclusively governed by Belgian law. Any dispute will be brought before the courts of the judicial district of the head office of OLIO SASA, namely; the Courts of Namur.
